The argument of whether DMCH owns a valid logo or not will be settled in court. Trademark infrigment is kind of like patent infringment. It gives the owner a "license" to sue people who use it without permission. All the lawyer letters aside only a court can legaly stop someone and it takes $$$ to protect your trademark. Unless DMCH gets an injuction to stop someone all they can do is threaten. In fact that is the first step in trying to protect your intellectual property. You have to show the court you tried to protect your rights. By not protecting your rights you could lose them. A fat file of "cease and desist" letters can go a long way towards proving you tried to protect your trademark. In any case most people would not contest a lawyer letter and just stop using the logo. What I find hard to understand is why DMCH deosn't just make everyone sign a "use" letter and charge a minimal fee. Once you sign the use letter in effect you agree that DMCH has ownership rights and they CAN enforce that.
