Assuming: a) you caught the truck b) the truck driver HAS insurance c) the insurance company is cooperative You are right. In the real world your insurance company pays out and then tries to collect from the other company if possible under what is called "Subrigation". If successful they reimburse the deductible. The other way is for you to directly file a claim against the truck driver's insurance. A lot of time-consuming and annoying work. Not always successful. Especially with trucks. You usually wind up dealing with a company in another State and they don't care about you. Too easy for them to "blow you off". They will say you had the damage before the truck hit you for instance and try to make you prove the car was undamaged BEFORE the accident. They may also claim the accident was partly your fault so you should pay for some of the repair. By stalling and making it as hard for you as they can they hope you will give up and go away. They know it's expensive for you to go after them in another State.
