Yeah, but you're still justified in killing. If you wave a toy gun
around at a cop, they'll shoot you. If you commit a crime with a toy
gun - for that matter, if you even stick your finger in your jacket
and play like you have a gun - you'll be charged just as if you'd
committed the crime at gunpoint in most states (crimes with guns
usually carry much higher penalties).
