All discussions about ownership of the logo have been
for trademark in the USA. If your doing business
elsewhere, You would best check in the country you are
doing business.
As far as "the truth" of ownership in the USA...
Everyone I have spoken to who works with IP law says
that *IF* the case were to go to court, DMCH would
LOOSE the claim... But the truth is, no one will
challenge them and they know it. They control the
logo only because no one will challenge it.
This it typical of all IP law. It is usually a matter
of "path of least resistance". For those who have a
license agreement with DMCH to use the logo, the fees
are less than what it would cost to challenge the
claim.. It is an unwise business (financial) decision
for anyone to challenge them. It sucks, but the only
way it will change is if people fight for what is
morally correct even if not cost effective.
I have tried public pressure, which is much less
expensive than legal... But it seems to have failed.
Most people (on any issue) are apathetic even when it
has a direct impact on them.
If DMCH wanted to keep control of the logo, and be
fair about profiting from something they really don't
own, they would offer you a deal where you can use the
logo for a $1 fee (Money has to change hands for it to
be a legal contract). Did they offer you any options?
or just tell you NO you can use it?
