I have done this, and as I have said so many times on this list (so much so that I am even sick of hearing it), you can CLAIM anything you want.. Only a judge can decide. So, as Mike said before, unless someone challenges DMCH in court over ownership of the trademark they own it simply because they claim they do (and filled out the paperwork/paid the fees with the USPTO). ... and the more time that passes, the better chance DMCH has of winning such a case in court. The best shot someone has at "winning" a lawsuit over ownership would be to prove they were using the logo for a BONA FIDE BUSINESS PURPOSE prior to DMCH registering it. There are only a small handful of people who fall in to that category, and they all need the cooperation of DMCH for their livelihood.
